What lands on the table

Three kinds of Palm Bay file, and what each one takes.

1960s

A deed with its seal

GDC-era lots

Chains that have not moved in decades. Heirs and estates on owners who died out of state. Successor questions running GDC to Atlantic Gulf Communities to the bulk lot buyers. Assembly needs unity of title.

Tax deeds and Lands Available

Vacant, out-of-state-owned lots are what reaches the Brevard Clerk’s tax deed sale. A Florida tax deed needs curative work before the title is marketable, so call before you bid.

Chapter 713

New construction

Chapter 713 releases, notices to owner, final affidavits, permit closeout and CO timing. The risk is a subcontractor who was never paid.

GDC cut the streets, drew the lots and sold them, many to buyers who never stood on the ground.

Port Malabar, 1959

One company platted this city, and the title work has never finished.

General Development Corporation bought the land in 1959 and called it Port Malabar. Palm Bay incorporated on 16 January 1960. It went bankrupt in 1991.

The City’s own comprehensive plan says about 90% of Palm Bay was “planned and platted in the early 1960s” and that “land ownership is extremely fragmented.”

The clearest surviving piece is the Compound, in the southwest quadrant: Port Malabar Units #51, #52 and #53. In the City’s words, there is “no existing water, sewer, or electrical infrastructure” inside it.

City of Palm Bay figures.

23.7% since the 2020 census

Palm Bay is building fast, and Brevard will not e-record the plat.

Palm Bay went from 119,760 residents at the 2020 census to an estimated 148,092 on 1 July 2025. Melbourne grew 2.8%.

Palm Bay went from 119,760 residents at the 2020 census to an estimated 148,092 on 1 July 2025. Melbourne grew 2.8%.

HUD’s 2021 market analysis found about 30% of every home built in the wider Palm Bay-Melbourne-Titusville market over the preceding five years went up here. Brevard e-records through CSC, ePN, HopDox and Simplifile. Plats sit on the exclusion list, so a new subdivision plat is recorded conventionally at the Clerk.

Four in five homes here are owner-occupied and 19.0% of residents are 65 or over, so there are fewer probate and life-estate transfers than in Vero Beach or Melbourne.

Questions we get from Palm Bay

Six questions Palm Bay buyers and sellers ask.

My family bought a Palm Bay lot in the 1970s and never built on it. What will the search find?

Usually a chain that has not moved since GDC sold the lot, so the owners today are heirs rather than the names on the deed. Port Malabar lots sold to out-of-state buyers in volume, so probate is often open elsewhere.

There is a paved road to the lot but no water, sewer or electric. Can I still close on it?

Yes, because title insurance covers ownership rather than buildability. The City says there is no existing water, sewer or electrical infrastructure inside the Compound, so get the utility answer before you sign.

Palm Bay sent a letter saying sewer is available on my street. Does that reach the closing?

It does. The City’s mandatory connection rule runs one year from the date of that written notification, and a buyer inherits the clock and the cost.

I am buying a Palm Bay lot at a Brevard tax deed sale. Will a title company insure it?

Usually not on the deed alone. A Florida tax deed generally needs a quiet title action or curative work before the title is marketable, so call before the sale, not after.

I am buying new construction in Palm Bay. What stops a lien after I close?

Chapter 713 releases from the contractor and every supplier who served a notice to owner, plus the contractor’s final affidavit, reviewed before we disburse.

Do I have to close in Palm Bay, or drive up to Titusville?

Neither. You sign at our office at 1208 US-1 in Sebastian, about 26 minutes down US-1, and we handle the recording with the Brevard County Clerk from there.

Why Paradise Title

Who actually handles your Palm Bay file.

Paradise Title has been closing from the 1919 brick house at 1208 US-1 in Sebastian since 2005. Diane Shampine and Kim Muir run the closings, and Sandy Carpenito searches and examines the title here in our own office rather than sending it to a vendor three states away. Between the three of them there is more than 75 years of title work. We are an independently owned title and escrow company, and an agent for Chicago Title Insurance Company, part of Fidelity National Financial.
